The terms governing your use of the BrightPath Education platform and services

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and BrightPath Education Pty Ltd (ABN 65 366 917 788) ("BrightPath", "we", "us", or "our"), governing your access to and use of the BrightPath Education platform, website, and related services (collectively, the "Service").
By creating an account, accessing our platform, or using any part of our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
If you are creating an account on behalf of a minor (a person under 18 years of age), you represent that you are the parent or legal guardian of that minor and accept these Terms on their behalf.
BrightPath Education is an online tutoring and learning platform providing interactive educational content for students from Kindergarten to Year 12 (K–12), with a focus on Mathematics and English, aligned to the Australian Curriculum v9.
The Service includes, but is not limited to:
BrightPath is an educational supplement and does not replace formal schooling, tutoring by a qualified teacher, or professional educational assessments. We do not guarantee specific academic outcomes or results.
To use the Service, you must create an account subject to the following conditions:
We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used fraudulently.
Credit card required — cancel anytime before day 14 to avoid being charged
A valid credit or debit card is required to start your free trial. You will not be charged during the 14-day trial period. If you do not cancel before the trial ends, your subscription will begin automatically and your card will be billed.

No lock-in contracts
You can cancel your subscription at any time. There are no cancellation fees, exit fees, or lock-in periods for weekly plans.
You agree to use the Service only for its intended educational purposes and in compliance with all applicable laws. You must not:
Violation of these acceptable use terms may result in immediate suspension or termination of your account without refund.
All intellectual property rights in and to the Service, including but not limited to:
are owned by or licensed to BrightPath Education Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial educational purposes only. This licence does not include any right to:
To the maximum extent permitted by law, and subject to Section 10 (Australian Consumer Law):
Nothing in these Terms is intended to limit or exclude liability that cannot be limited or excluded under Australian law, including liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the Australian Consumer Law.
Your consumer guarantees are protected
Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:
For major failures with the service, you are entitled to cancel your subscription and receive a refund for the unused portion. For minor failures, we are entitled to remedy the failure within a reasonable time. If we fail to do so, you are entitled to cancel and receive a refund.
If a dispute arises in connection with these Terms or the Service, the parties agree to follow this dispute resolution process:
Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.
We may modify these Terms from time to time. When we make changes:
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.
