The terms governing your use of the BrightPath Education platform and services

1 Overview

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and BrightPath Education Pty Ltd (ABN 65 366 917 788) ("BrightPath", "we", "us", or "our"), governing your access to and use of the BrightPath Education platform, website, and related services (collectively, the "Service").

By creating an account, accessing our platform, or using any part of our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

If you are creating an account on behalf of a minor (a person under 18 years of age), you represent that you are the parent or legal guardian of that minor and accept these Terms on their behalf.

2 Service Description

BrightPath Education is an online tutoring and learning platform providing interactive educational content for students from Kindergarten to Year 12 (K–12), with a focus on Mathematics and English, aligned to the Australian Curriculum v9.

The Service includes, but is not limited to:

  • Interactive lessons, quizzes, and practice exercises across multiple subjects
  • Diagnostic assessments to identify learning gaps and strengths
  • Personalised learning pathways and recommendations
  • Progress tracking, XP systems, and achievement features
  • Enrichment content including coding, science, financial literacy, and more
  • Parent dashboards and progress reports

BrightPath is an educational supplement and does not replace formal schooling, tutoring by a qualified teacher, or professional educational assessments. We do not guarantee specific academic outcomes or results.

3 Account Terms

To use the Service, you must create an account subject to the following conditions:

  • Age requirement: Accounts must be created by a person aged 18 years or older. For students under 18, a parent or legal guardian must create and manage the account.
  • Accurate information: You must provide accurate, current, and complete information when creating your account and keep it up to date.
  • Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect any unauthorised access.
  • One account per family: Each subscription plan covers one family. You may add multiple child profiles under a single parent account as permitted by your plan.
  • No account sharing: Your account is personal and may not be shared with, transferred to, or used by individuals outside your immediate household.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used fraudulently.

4 Free Trial

Credit card required — cancel anytime before day 14 to avoid being charged

A valid credit or debit card is required to start your free trial. You will not be charged during the 14-day trial period. If you do not cancel before the trial ends, your subscription will begin automatically and your card will be billed.

We offer a free trial of the Service under the following conditions:

  • Duration: The free trial period is 14 days (2 weeks), commencing from the date of account creation.
  • Payment details required: A valid credit or debit card is required to start the free trial. Your card will not be charged during the trial period.
  • Automatic conversion: If you do not cancel before the end of the 14-day trial period, your subscription will automatically begin and your payment method will be charged at the applicable plan rate.
  • Reminder email: We will send you an email reminder 3 days before your trial ends so you have time to cancel if you do not wish to continue.
  • How to cancel: You can cancel at any time through your account settings before the trial ends. No charge will be made if you cancel during the trial.
  • Full access: During the trial period, you will have full access to all features of your chosen plan — Primary School (Kindergarten–Year 6) or Secondary School (Year 7–Year 12).
  • One trial per household: Free trials are limited to one per household. We reserve the right to restrict trial access if we detect misuse.

5 Subscription & Billing

BrightPath Education offers the following subscription plans. All prices are in AUD and all plans include a 14-day free trial.

Sibling discount: 50% off each additional child on a Year 1+ plan. Add-ons are billed on the same billing cycle as the primary subscription.

Billing Terms

  • Billing cycle: Weekly subscriptions are billed every 7 days. Monthly subscriptions are billed every 30 days. 6-month subscriptions are billed every 6 months. Annual subscriptions are billed as a single upfront payment.
  • Payment methods: We accept major credit cards, debit cards, and selected digital payment methods. All payments are processed securely by our PCI-compliant payment provider.
  • Automatic renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
  • Price changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase. Price changes will take effect at the start of the next billing cycle following the notice period.
  • Failed payments: If a payment fails, we will attempt to process it again within 7 days. If payment continues to fail, your access to premium features may be suspended until payment is resolved.
  • All prices are in Australian Dollars (AUD) and inclusive of GST.

Referral Programme

Earn 1 free month for every friend you refer

Credit is applied automatically to your account and offsets your next bill. No action required from you once your friend is signed up.

BrightPath operates an optional referral programme under the following terms:

How it works

  • Eligible subscribers receive a unique referral link in their account dashboard.
  • When a new subscriber signs up through your referral link and maintains an active paid subscription for the qualifying period, you receive a credit equal to one month's equivalent value of their plan applied to your BrightPath account balance.
  • The credit automatically offsets your next billing charge. No cash payments are made.

Qualifying periods by plan

The reward is issued once your referred friend has completed the following payments:

  • Monthly plan: 12 consecutive monthly payments (approximately 1 year of continuous subscription).
  • 6-month plan: 2 payments (the initial payment plus the renewal at the 6-month mark, totalling approximately 12 months).
  • Annual plan: 1 payment. The reward is issued approximately 14 days after the friend's annual payment is confirmed, to allow time for payment disputes to be resolved.

Eligibility & restrictions

  • New subscribers only: The referred friend must be a new BrightPath subscriber with no prior account.
  • No self-referral: You may not refer yourself or any person sharing your household or payment method.
  • One reward per referral: Each referred friend generates a maximum of one reward, regardless of how many children they enrol.
  • No limit on referrals: You may refer as many friends as you like, subject to these terms.
  • Active subscription required: You must have an active BrightPath subscription at the time the reward is issued to receive the credit.
  • Disputes and chargebacks: If the referred friend raises a payment dispute or chargeback before the reward is issued, the reward will be cancelled.

Programme changes

  • BrightPath reserves the right to modify, suspend, or end the referral programme at any time without notice.
  • Rewards already issued will not be affected by subsequent changes to the programme.
  • Pending rewards (where the qualifying period has not yet been completed) may be affected if the programme is materially changed; we will endeavour to honour rewards where the friend has already completed the majority of their qualifying period.

6 Cancellation & Refunds

No lock-in contracts

You can cancel your subscription at any time. There are no cancellation fees, exit fees, or lock-in periods for weekly plans.

Cancellation

  • You may cancel your subscription at any time through your account settings or by contacting our support team.
  • Weekly plans: Cancellation takes effect at the end of the current billing week. You will retain access until the end of the paid period.
  • Annual plans: Cancellation takes effect immediately, but you retain access for the remainder of the annual period already paid for.
  • Your account and learning data will be retained for 90 days following cancellation, allowing you to resubscribe without losing progress.

Refund Policy

  • Weekly plans: No refunds are provided for weekly subscriptions, as there is no lock-in and you can cancel at any time.
  • Annual plans: No refunds are provided for annual subscriptions. If you cancel, you will retain full access to the Service until the end of the paid annual period, after which your subscription will not renew.

7 Acceptable Use

You agree to use the Service only for its intended educational purposes and in compliance with all applicable laws. You must not:

  • Share your account login credentials with anyone outside your immediate household
  • Allow others to access the Service through your account for commercial purposes, including tutoring businesses or schools (separate institutional licences are available)
  • Copy, reproduce, distribute, modify, or create derivative works of any content on the platform
  • Use automated tools, bots, scrapers, or any technology to access, collect, or extract content or data from the Service
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Use the Service to transmit harmful, offensive, or illegal content
  • Misrepresent your identity or impersonate another person
  • Use the Service in any way that could damage, disable, or impair the platform

Violation of these acceptable use terms may result in immediate suspension or termination of your account without refund.

8 Intellectual Property

All intellectual property rights in and to the Service, including but not limited to:

  • Lesson content, quizzes, assessments, and educational materials
  • The BrightPath name, logo, and branding
  • Website design, user interface, and user experience
  • Software, code, algorithms, and technical infrastructure
  • Graphics, illustrations, animations, and multimedia content
  • Curriculum maps, learning pathways, and educational methodologies

are owned by or licensed to BrightPath Education Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial educational purposes only. This licence does not include any right to:

  • Resell, sublicence, or commercially exploit any content
  • Download, copy, or store content beyond what is necessary for personal use (e.g., printing a single worksheet for your child)
  • Remove any copyright, trademark, or proprietary notices

9 Limitation of Liability

To the maximum extent permitted by law, and subject to Section 10 (Australian Consumer Law):

  • The Service is provided "as is" and "as available" without warranties of any kind, except those that cannot be excluded under Australian law.
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
  • We do not guarantee specific educational outcomes, grades, or academic improvements from using the Service.
  • BrightPath's total liability to you for any claims arising from or related to the Service is limited to the total amount you have paid to us in the 12 months preceding the claim.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of opportunity.

Nothing in these Terms is intended to limit or exclude liability that cannot be limited or excluded under Australian law, including liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the Australian Consumer Law.

10 Australian Consumer Law

Your consumer guarantees are protected

Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:

  • Services supplied with due care and skill
  • Services that are fit for any specified purpose
  • Services supplied within a reasonable time
  • A remedy (repair, replacement, or refund) if the services fail to meet a consumer guarantee

For major failures with the service, you are entitled to cancel your subscription and receive a refund for the unused portion. For minor failures, we are entitled to remedy the failure within a reasonable time. If we fail to do so, you are entitled to cancel and receive a refund.

11 Dispute Resolution

If a dispute arises in connection with these Terms or the Service, the parties agree to follow this dispute resolution process:

  1. Informal resolution: You must first contact us at [email protected] to attempt to resolve the dispute informally. We will make reasonable efforts to resolve the matter within 14 days.
  2. Mediation: If the dispute cannot be resolved informally within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) in Sydney, NSW. The costs of mediation will be shared equally unless agreed otherwise.
  3. Court proceedings: If the dispute is not resolved through mediation within 60 days of referral, either party may commence court proceedings in the courts of New South Wales, Australia.

Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

12 Changes to Terms

We may modify these Terms from time to time. When we make changes:

  • We will provide at least 30 days' notice before material changes take effect, via email to your registered email address and a notice on our platform.
  • We will update the "Last updated" date at the top of these Terms.
  • For non-material changes (such as formatting or clarification), we may update the Terms without prior notice.
  • Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
  • If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect. If you are on an annual plan, you will retain access until the end of your current paid annual period, with no refund for the unused portion.

13 Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.
